TIER 1 INVESTOR VISA ILR
After two, three, or five years in the UK, you may be entitled to
apply for indefinite leave to remain in the UK as a Tier 1 Investor or Tier 1 Investor ILR.
The standards you must meet
in order to qualify for Tier 1 Investor visa ILR will vary depending on when
your initial Tier 1 Investor visa was awarded and the amount of your
investment.
Investor visa Tier 1 ILR: Tier 1
Investor visa granted before November 6, 2014.
If you successfully applied for your Tier 1 Investor visa before
November 6, 2014, and intend to apply for indefinite leave to remain as a Tier
1 Investor, you must demonstrate to UK Visas & Immigration:
You have money in the UK that you own and control that is worth at
least £1 million.
You have invested at least 75% of your capital in the UK through
UK Government bonds, share capital, or loan capital in active and trading UK
registered firms; and the remaining balance has been invested through asset
purchases or money on deposit in the UK regulated financial institution.
The investment was made no more than 12 months before the
application that resulted in the first award of leave as a Tier 1 Investor
Migrant;
You have maintained the same level of investment throughout the
duration of your absence;
You have spent a continuous period of at least 2 years (if you
have maintained an investment of at least £10 million), 3 years (if you have
maintained an investment of at least £5 million), or 5 years (if you have
maintained an investment of at least £1 million) lawfully in the UK as a Tier 1
Investor, with no more than 180 days absent from the UK in any 12 months during
the period;
Unless you are 65 or older, you have adequate knowledge of the
English language and life in the United Kingdom.
You must submit your Tier 1 Investor ILR application by April 6,
2022. If you apply for indefinite permission to remain on or after April 6,
2022, but before April 6, 2025, you must have invested at least £2 million in
active and trading.
UK registered companies or UK Government bonds during a 5-year
period. You can only consider time since your investment was increased to £2
million in your continuous period.
If you apply for ILR on or after April 6, 2025, you must have
invested at least £2 million in active and trading UK registered companies or
UK Government bonds during a 5-year period.
Any investment, however, must be shifted out of UK Government
bonds and into other qualified investments by April 6, 2025.
Tier 1 Investor visa ILR: The first
Tier 1 Investor visa was awarded between November 6, 2014, and March 28, 2019.
If you successfully applied for your Tier 1 Investor visa between
November 6, 2014, and March 28, 2019, you will be entitled to apply for Tier 1
Investor ILR if you meet the following criteria:
You have money of your own, under your own control, in the UK
amounting to not less than £2 million;
You have invested your
capital in the UK by way of UK Government bonds, share capital or loan capital
in active and trading UK registered companies;
The investment was made no more than 12 months before the
application that resulted in the first award of leave as a Tier 1 Investor
Migrant;
Tier 1 Investor visa ILR: On or after March
29, 2019, the initial Tier 1 Investor visa will be awarded.
If you successfully applied for your Tier 1 Investor visa on or
after March 29, 2019, you must meet the following requirements to be eligible
for Tier 1 Investor ILR:
You have money of your own, under your own control, in the UK
amounting to not less than £2 million; You have invested your capital in the UK
by way of share capital or loan capital in active and trading UK registered
companies;
The investment was made no more than 12 months before the
application that resulted in the first award of leave as a Tier 1 Investor
Migrant;
Investor visa Tier 1 Timeline for ILR
settlement
Once you have lived in the UK as a Tier 1 Investor for a
continuous period of 5 years, you can apply for ILR using the Tier 1 Investor
route. However, as a Tier 1
Investor, you may apply for accelerated ILR after a continuous
period of either two or three years if you have maintained an investment of at
least £10 million or £5 million.
Investor visa Tier 1 ILR residency is
required.
To be eligible for indefinite leave to remain (ILR) as a Tier 1
Investor, you must have not been gone from the UK for more than 180 days in any
12 month period throughout your qualifying 2, 3, or 5-year term.
For any absences from the UK during periods of leave granted under
the Rules in effect before 11 January 2018, you must not have been absent
from the UK for more than 180 days in any consecutive 12-month period ending on
the same date of the year as the Tier 1 Investor visa ILR application.
The Home Office will charge
a fee for any absences outside the UK during periods of leave granted under the
Rules in effect since 11 January 2018.

Investor visas
If you apply for indefinite permission to remain as a Tier 1
Investor through UK Visas & Immigration's standard procedure, you can
usually expect a decision within 26 weeks of the date of your application.
If you use the priority service to apply for a Tier 1 Investor
visa ILR, you should receive a decision within 10 working days of your UKVCAS
appointment.
