Indefinite Leave to Remain: The Three and Five-Year Pathways to Settlement
After 5 or 3 years of indefinite permission to remain, a person no longer needs to apply to extend their stay in the UK.
They are allowed to stay in
the UK permanently because they have settled here. Except for British
Citizenship, it is the most secure immigration status in the UK.
In most situations, in order to qualify for Indefinite Leave to
Remain, you must have lived legally in the UK for 5 years with no long
absences.
Certain types of visas, such as student visas and Intra-Company
Tier 2 visas, do not allow you to apply for Indefinite Leave.
If you have been in the country for three years, you can apply for Indefinite Leave to Remain.
You can apply for Indefinite Leave to Remain after 5 years if you
are in specific Tier 1 categories or as an Innovator or Global Talent migrant.

On an Ancestry visa, you must pass two tests: the Life in the UK
Test and the English Language Test.
You must still meet all of the requirements for your existing visa
status.
If you are unable to do so, you may be forced to take the 'Ten
Year Route to Settlement.'
You cannot apply for British citizenship through this procedure if
you do not have Indefinite Leave to Remain.
If you are married to a British citizen, you are eligible to apply
for British citizenship as soon as you are granted Indefinite Leave to Remain.
If you are not, you must wait a minimum of 12 months before
applying for citizenship.

What is the procedure for ILR?
After you've filed your application, you'll need to go to a visa application center near you to get your fingerprints and photo taken. The Home Office may take up to six months to make a decision, after which you will be issued a Biometric Residence Card proving your new Indefinite Leave to Remain status.
