Making an application for a visa extension or Indefinite Leave to Remain
If your visa expires during your work, you must apply to the UKVI for an extension or Indefinite Leave to Remain (ILR)
Your Tier 1 or Tier 2 entrance visa will have an expiration date
on it. The expiry date will be recorded on your employee records.
If you are still working by the University three months before
your visa expires, we will send you a notice to your University email account,
reminding you to contact the UKVI if necessary.
One of the key requirements for receiving a visa extension, or
Indefinite Leave to Remain, is that you have lived in the UK for the majority
of the previous visa period.
This means that you must not have spent more than 180 days outside
the UK in any 12-month period. If there have been more than 180 days of
absence, the extension or ILR is likely to be denied.
Extensions of visas
Within 60 days of the visa's expiration date, you may request an
extension. Visa extensions vary, but you can only be sponsored through Tier 2
for a maximum of 6 years.
Please keep in mind that there are no promises that your visa will
be extended.
The decision to extend your visa will be based on your continued
residency in the UK during the initial visa period, as well as UK policy at the
time of renewal.
If you want to extend a visa associated with a Tier 2 certificate
of sponsorship, the University must file for a fresh certificate of sponsorship
against which the visa can be considered.

While you are in the UK, you must apply for a Tier 2 visa
extension. You cannot make an out-of-UK Tier 2 visa extension application.
Therefore, if you are near to the expiry date of your Tier 2
related visa and you leave the UK, you must check that you can return to the
UK, and make an extension application, before your visa expiry date.
Leave to Remain indefinitely (ILR or
Settlement)
When the extended period for a Tier 2 visa expires, you may apply
for Indefinite Leave to Remain (ILR).
The UKVI will consider a
number of considerations while evaluating an application for ILR, as detailed
on the ILR webpage. One of these is demonstrating your continued residence in
the UK.

Even if you have been working and living in the UK for five years, ILR is not assured.
If you receive an ILR visa, you will have ongoing and unrestricted
eligibility to work in the UK.
You must submit your ILR
visa to HR so that we can create the necessary copies and update our records.
